【勞工處｜僱傭條例】年終酬金

根據《僱傭條例》，有關年終酬金的規定適用於按連續性合約受僱，而僱傭合約內（包括口頭或書面、明言或暗示）訂明可享有年終酬金的僱員。年終酬金是指根據僱傭合約訂明每年發放的酬金，包括雙糧、第13個月糧、年尾花紅等，但不包括屬實贈性質或隨僱主酌情發放的款項。酬金期應根據僱傭合約內指明的期間，如果沒有指定，則以農曆年度計算。如符合《僱傭條例》的規定，僱員在一個酬金期內按照連續性合約受僱不少於三個月，可按比例獲部分年終酬金。
