【勞工法例】Take Offer後即反悔有無違反法例?簽約後Reject offer email應該點寫?

簽約後reject offer是否違反法例,需要視乎你與該公司所簽署的合約而定。根據法例,你需要先釐清合約是簽約日生效,還是入職日生效。如果是前者,無論是僱員或是僱主有違約行為,均需按合約或法例條款作出賠償;但如果是後者,即合約仍未生效,故並不存在毀約行為的疑慮。

一般而言,僱傭合約會於上班第一日開始生效,如果你於此日期前向公司表示拒絕Offer,由於合約期仍未生效,所以公司不能逼令你支付代通知金。除非合約中有訂明「毀約賠償條款」、培訓費等條款。另外,僱傭合約有明文規定,在試用期內的首個月,可以無需通知期或代通知金,即時離職。
